OAB-PA condena decisão de juíza que liberou bacharéis sem exame da classe

Belém (PA), 17/01/2008 – A presidente da Seccional do Pará da Ordem dos Advogados do Brasil (OAB-PA), Ângela Salles, criticou hoje (17) a decisão, em caráter liminar, da juíza federal da 23ª Vara Federal do Rio de Janeiro, Maria Amélia Senos de Carvalho, permitindo que seis bacharéis em direito, mesmo reprovados no exame de Ordem, possam exercer a advocacia. A liminar foi concedida pela juíza sob o argumento de que o exercício da profissão está limitado à capacitação e não à aprovação no exame da OAB. O presidente da OAB do Rio de Janeiro (OAB-RJ), Wadih Damous, entrou com recurso que será julgado pelo desembargador Raldênio Costa, relator da 8ª Turma Especializada do Tribunal Regional Federal da 2ª Região.
Para Ângela Salles, a decisão da magistrada é um fato inédito desde a implantação do novo estatuto da Ordem, em 1994, que determinou a exigência da aprovação do exame para que os bacharéis em Direito exerçam a advocacia. Esta decisão contraria a jurisprudência da justiça federal em todo o país que tem o entendimento de que é necessário o exame da Ordem para advogar no nosso país, assinala. Ela contesta o argumento da juíza lembrando que o requisito para advogar não se limita à capacitação, porque é preciso ter além de idoneidade moral, habilidade para o exercício da profissão, critério que é avaliado no exame.
Salles acrescenta que a liminar é um fato isolado, que não deve ser confirmado pelo TRF ou mesmo pelo Superior Tribunal de Justiça (STJ)
