O QUE SE ENTENDE POR LOWFARE?

Com a ascensão do Doutor Cristiano Zanin a Ministro do Supremo Tribunal Federal, sabatinado ontem pelo Senado da República em sessão pública das mais concorridas dos últimos tempos, vem a tona tema importantíssimo sobre o LAWFERE. Tratado em obra de sua autoria em parceria com sua esposa, ambos advogados militantes nos Tribunais Superiores de nosso país.
Essa obra do eminente Ministro, podemos dizer assim, escrito no momento do desenrolar da “ Lava Jato”, pode e deve ser estendida no contexto legal e no arcabouço jurisprudencial brasileiro, em razão da suma importância e relevância que exprime.
Antes de adentrarmos de forma muita sucinta a essa figura jurídica, faremos um brevíssimo escorço histórico de sua origem.
Foi debatida pela primeira vez nos Estados Unidos da América do Norte, nos idos de 1975, mas incorporado no Brasil em momentos de grandes tensões jurídicas e políticas no final de 2016. Retrata a espetacularização que causa prejuízos imensos as decisões judiciais, ferindo de morte a sustentação do Estado Democrático de Direito ,presunção da inocência, direito à intimidade, o juízo natural.
Não temos como confundir o LAWFERE com o célebre ativismo judicial, que grassa em muitas de nossas cortes, até mesmo nos juízos singulares, embora possa em alguns momentos ter uma similitude ou correspondência aparente .
O termo LAWFERE significa ao pé da letra, law ( direito )warfere ( guerra), como se a lei fosse usada como uma arma de guerra. Seriam os Estados soberanos, no âmbito do direito internacional, como forma de ataque para deslegitimar o inimigo e alcançar o êxito através dessas normas escritas substituindo as armas convencionais, isso consubstanciada com a influência das mídias espetacularizando os fatos e jogando-os a opinião pública que se tornam facilmente massa de manobras ao alvedrio de interesses os mais escusos possíveis.
O Ministro Cristiano Zanin, sua esposa Walesca Teixeira Matins Zanin, levaram ao público essa monumental obra, em dueto tal qual, fizeram John Camaroff e Jean Camarof , caracterizando a LAWFERE , “como recursos a instrumentos legais, à violência atinente ao direito, para cometer atos de coerção política e até de eliminação quando se torna visível, evocando legalidades para agir contra alguns ou todos os cidadãos “ . Como asseveramos acima , este conceito foi inserido no Brasil , pela primeira vez pelo advogado Cristiano Zanini e sua esposa Walesca Zanin , como tese de defesa do Presidente Luiz Inácio Lula da Silva , no âmbito da Operação “ Lava Jato “ que o definem “ como o uso estratégico do direito com a finalidade de desconstruir, deslegitimar, prejudicar ou aniquilar o inimigo”.
Esse breve artigo se contemporiza a qualquer momento de nossa história, não está adstrito ao seu fator originário, mas se expande desde quando a lei deixa de ser a fiel escudeira dos direitos humanos e se torna meio de destruição dos direitos mais lídimos da sociedade humana.
Basta essa obra do Ministro Cristiano Zanin para acreditar-mos que se tornará um ícone na defesa intransigente dos direitos individuais e coletivos de nossa sociedade, além de ter sido um advogado atuante nas mais variadas causas independentemente da importância de seus clientes nestes vinte e cinco anos no “ batente”. Combatendo o bom combate, saciando àqueles que tinham fome e sede de justiça, oscultador das dores, sacrifícios e lutas que foram ao seu encontro minimizar ou extirpar seus males a procura de uma justiça plena.
